GOVERNOR Benigno R. Fitial says federalizing local immigration may result in widespread immigration fraud.In his latest statement against the pending federalization bills in the U.S. Congress, Fitial said he anticipates federalization to take effect by July 1, 2008, and this is why, he added, his administration came up with a thorough account of all documented foreign workers on the islands.He said giving long-time guest workers the opportunity to have nonimmigrant visas will likely result in scams.Both H.R. 3079, the Northern Mariana Islands Immigration, Security and Labor Act, and S. 1634, the Northern Mariana Islands Covenant Implementation Act, will grant migrant workers who have been legally residing in the islands a five-year nonimmigrant status that will allow them to travel, work and study anywhere in the United States.“This proposal will likely result in widespread fraud,” the governor said. “A status that entitles someone to reside permanently in the CNMI or any other part of the United States is a valuable commodity. People will inevitably try in every possible way to get that status. We, in the commonwealth, will have very serious law enforcement problem as a result.”He said sham marriages among foreigners seeking to upgrade their immigration status are already happening on the islands.He added that there are also cases of sham adoptions.“Fraudulent documents such as birth and marriage certificates from foreign countries are already a problem. We will likely see much more of that if this proposal is enacted,” the governor said.“Then there is the large “second wave” problem, he added. Aliens who gain permanent resident status under the federalization measures are entitled under U.S. immigration law to bring in siblings, parents, children, spouses and other relatives, Fitial said..The Human Dignity Act Movement, which represents a significant population of migrants who stand to benefit from the federalization measures, said migrant workers have been the CNMI’s partner in building its economy.“We have employment, families and friends here,” the group said in a position paper submitted to the U.S. Congress, other federal officials and the United Nations Commission on Human Rights. “We volunteer in the community and support the schools. Any problems and lack of stability that we encounter is due to the fact that presently we have no status and no security.”It added, “If given status, we will be able to help rebuild the fallen economy of the Northern Marianas…. We are skilled laborers and professionals who have diligently served in all of the major industries and fields in the CNMI.”The group’s president, Jerry Custodio, said many of the migrants who stand to benefit from the pending federalization measures are parents of U.S.-born children who want to keep their families together.“If we are forced to leave the CNMI with our children, they will not have the benefits that other U.S. citizen children living in any U.S. soil have and deserve,” he said. “They will be living with jobless parents in strange lands. They will not have the educational opportunities that they have known here.”He added, “Many guest workers that travel to other countries in the world to work are given opportunities to become citizens…and political rights. The status offered by H.R. 3079 and S. 1634 does not include political rights…. But it does guarantee security and the (privilege) to live and work in the United States. Thus, we would be able to remain in the CNMI to support our families without the constant fear of being deported.”
